1. Acceptance of Terms

By creating an account or using PangMeryenda, you agree to these Terms, our Privacy Policy, and all applicable laws and regulations of the Republic of the Philippines, including but not limited to the Electronic Commerce Act (R.A. 8792), Data Privacy Act (R.A. 10173), and the Consumer Act (R.A. 7394). If you do not agree to these Terms, you may not use our services.

2. Eligibility

You must be at least 18 years old to use PangMeryenda. By using our platform, you represent and warrant that you are of legal age and have the legal capacity to enter into a binding agreement. Users under 18 are prohibited from creating accounts or making transactions.

3. Account Registration

When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

4. Platform Services

PangMeryenda provides a platform for:

• Creators: To receive support from fans through donations, sell digital products, and offer membership subscriptions
• Supporters: To support creators financially and access exclusive content and products

We act as an intermediary platform and do not directly sell products or services. Transactions are between creators and supporters, with PangMeryenda facilitating payment processing.

6. Refund Policy

In accordance with the Consumer Act of the Philippines (R.A. 7394):

• Donations: Donations are voluntary and generally non-refundable once completed.
• Digital Products: Due to the nature of digital goods, refunds are handled on a case-by-case basis. Refunds may be granted if the product was not delivered or is significantly different from its description.
• Subscriptions: You may cancel your subscription at any time. Refunds for the current billing period are not provided, but you will retain access until the end of the period.

7. Creator Responsibilities

As a creator on PangMeryenda, you agree to:

• Provide accurate descriptions of your products and services
• Deliver purchased digital products in a timely manner
• Fulfill membership benefits as described in your tier offerings
• Respond to supporter inquiries reasonably
• Comply with all applicable Philippine laws regarding online commerce
• Not engage in fraudulent or deceptive practices

8. Prohibited Content and Activities

You may not use PangMeryenda to:

• Post or sell illegal content under Philippine law
• Distribute content that promotes violence, terrorism, or hate speech
• Share sexually explicit or pornographic material
• Engage in fraud, money laundering, or other financial crimes
• Violate intellectual property rights of others
• Harass, abuse, or threaten other users
• Impersonate other individuals or entities
• Attempt to circumvent platform security or fees
• Use automated systems to access the platform without permission
• Violate any applicable laws of the Republic of the Philippines

We reserve the right to remove content and terminate accounts that violate these prohibitions.

10. Limitation of Liability

To the maximum extent permitted by Philippine law, PangMeryenda shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the platform. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

PangMeryenda is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the platform will be uninterrupted, secure, or error-free. We are not responsible for the actions of creators or the quality of products sold on the platform.

12. Indemnification

You agree to indemnify, defend, and hold harmless PangMeryenda, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, violation of these Terms, or infringement of any rights of third parties.

13. Dispute Resolution

Any disputes arising from these Terms or your use of PangMeryenda shall be governed by the laws of the Republic of the Philippines. Disputes shall first be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Metro Manila, Philippines. 14. Modifications to Terms

We may modify these Terms at any time. Material changes will be communicated via email or platform notification at least fifteen (15) days before taking effect. Your continued use of PangMeryenda after changes become effective constitutes acceptance of the modified Terms.

15. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any reason with reasonable notice. You may delete your account at any time through your account settings. Upon termination, your right to use the platform ceases, but provisions regarding intellectual property, limitation of liability, and dispute resolution shall survive.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
